Wizdom AI is an AI-powered game asset generation platform that allows users to create various types of assets including buildings, characters, icons, and maps through artificial intelligence technology.

  • Making a purchase or creating assets

You acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference.

If you are agreeing to these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration and Responsibilities

3.1 Account Creation

Commercial use of our Services requires a valid commercial license. By purchasing a commercial plan, you agree to use generated assets only for the purposes specified in your license agreement.

4.3 Generated Content Usage Rights

Subject to your payment of applicable fees and compliance with these Terms, Wizdom AI grants you a worldwide, non-exclusive, royalty-free license to use, modify, and distribute assets generated through our Services. However, this license is subject to the following restrictions:

  • No resale or redistribution of our Services themselves
  • No creation of competing services
  • Attribution requirements for certain commercial uses
  • Compliance with applicable laws and regulations

5. Prohibited Uses

You agree not to use our Services to:

  • Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, or otherwise objectionable
  • Violate any applicable local, state, national, or international law or regulation
  • Infringe on any third party's intellectual property rights
  • Transmit viruses, malware, or any other malicious code
  • Attempt to gain unauthorized access to our systems
  • Use automated tools, bots, or scrapers to access our Services
  • Reverse engineer, decompile, or disassemble our technology
  • Create deepfakes or misleading content that could harm individuals or society
  • Generate content for military or weapons applications
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with the proper functioning of our Services

6. Content and Intellectual Property

6.1 User-Generated Content

By uploading content or using our AI generation features, you grant Wizdom AI a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display that content solely for the purpose of providing our Services.

6.2 Our Intellectual Property

Wizdom AI and its licensors retain all rights, title, and interest in our Services, including all software, algorithms, designs, trademarks, and other intellectual property. You may not use our trademarks without explicit written permission.

6.3 Copyright Policy

We respect intellectual property rights and expect our users to do the same. If you believe your copyright has been infringed, please contact us at legal@Wizdom AI.com with the required information under the Digital Millennium Copyright Act.

6.4 AI-Generated Content Rights

While users own the rights to assets generated through our Services (subject to these Terms and payment of fees), Wizdom AI retains the right to use anonymized, aggregated data from generations to improve our AI models and Services.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which forms part of these Terms. By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

Our Services utilize artificial intelligence technology, and we may collect usage data to improve our AI models. This data is anonymized and aggregated to protect individual privacy.

8. Payment and Billing

Certain features of our Services require payment. By purchasing credits, subscriptions, or other paid features, you agree to pay all fees and charges associated with your account.

9. Refund Policy

Credits purchased through our Services are generally non-refundable except in cases of technical errors on our part or as required by law. Subscription fees may be refunded within 30 days of purchase if you are not satisfied, subject to fair usage policies.

All refund requests must be submitted through our customer support system within the applicable timeframe.

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting customer support or using the account deletion feature in your settings.

10.2 Termination by Us

We may terminate or suspend your account immediately upon breach of these Terms or for other reasons we determine in our discretion.

10.3 Effect of Termination

10.4 Survival

Sections related to intellectual property, liability, indemnification, and governing law survive termination.

11. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT
  • WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE
  • WARRANTIES THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
  • WARRANTIES REGARDING THE ACCURACY OR RELIABILITY OF CONTENT GENERATED BY OUR AI

WE DO NOT WARRANT THAT THE RESULTS FROM USING OUR AI GENERATION TOOLS WILL MEET YOUR EXPECTATIONS OR BE SUITABLE FOR YOUR INTENDED USE.

12. Limitation of Liability

IN NO EVENT SHALL Wizdom AI, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

These limitations apply to the fullest extent permitted by law and survive termination of these Terms.

13. Indemnification

You agree to indemnify, defend, and hold harmless Wizdom AI and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of our Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content or conduct
  • Any claims related to assets you generate and use

14. AI-Specific Terms

14.1 AI Technology

Our Services use artificial intelligence and machine learning technologies. While we strive for quality and accuracy, AI-generated content may sometimes contain inaccuracies, biases, or unintended results.

14.2 Input and Output Limitations

You are responsible for the appropriateness of your inputs and the use of generated outputs. We reserve the right to refuse service or limit generation based on content guidelines.

14.3 Third-Party AI Services

Our Services may integrate with third-party AI services. We are not responsible for the performance, accuracy, or availability of these external services.

14.4 Ethical Use

You agree to use our AI tools ethically and responsibly, avoiding the creation of harmful, misleading, or illegal content.

15. Governing Law and Jurisdiction
